1. In accordance with Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce, we hereby inform you that the website www.MentorPlaces.com (hereinafter, the “Website”) is owned by MentorPlaces S.L., with Tax Identification Number (NIF) B19908763 and registered office at C/Aldea Real, 8, 28035 Madrid, Spain, registered with the Madrid Commercial Registry under Sheet M-833054, electronic folio IRUS: 100042955781, Registration No. 1 (hereinafter, “MentorPlaces”). Purpose
2. The purpose of the Website is to provide information to individuals and/or companies about courses, professions, scholarships, educational institutions and universities, accommodation and student financing, as well as any other content related to education and vocational training, and to offer and/or provide educational advisory services and/or career guidance to such individuals.
3. The Website also aims to act as an intermediary between:
- a. individuals and educational institutions, in order to help the former find courses that best suit their educational needs and to put them in contact with the latter.
- b. individuals and third-party providers of educational or related services, such as accommodation services, civil service examination preparation, financing services, etc., by putting the former in contact with the latter.
4. The Website also aims to assist educational institutions and training companies in promoting and presenting their educational offerings to individuals and companies.
5. Any other types of services not expressly covered by these terms are excluded from these conditions and shall be governed by their respective Terms and Conditions.
6. MentorPlaces may receive financial consideration from certain educational institutions or partner companies for the promotion, intermediation or acquisition of prospective students.
7. Such commercial relationships do not affect the provision of the guidance service; however, certain recommendations or content may be based on commercial agreements, which shall be indicated where applicable.
General Terms of Use
8. Access to and/or use of the Website confers the status of User. From such access and/or use, it is understood that the User accepts these General Terms of Use.
9. Use of or registration on the Website is limited to individuals who are at least fourteen (14) years of age.
10. The User undertakes to:
- a. Proper Use of the Services: The User agrees to use the Website and the services provided in accordance with the law, morality, public order and generally accepted standards of conduct. Use of the Website for unlawful purposes or in a manner that may harm the rights and interests of third parties is prohibited.
- b. Accuracy of Information: The User warrants that all information provided through registration forms or by any other means is true, accurate, up to date and complete.
- c. Confidentiality of Access Credentials: The User is responsible for maintaining the confidentiality of their username and password and assumes responsibility for all activities carried out under their account.
- d. Prohibition of Resale and Unauthorized Commercial Use: The User may not reproduce, duplicate, copy, sell, resell or commercially exploit, for any purpose, the information and/or services received without express consent.
- e. Respect for Intellectual Property: The User undertakes to respect the intellectual and industrial property rights of MentorPlaces and of third parties.
- f. Prohibition of Fraudulent Activities: The User undertakes not to engage in fraudulent activities, including the use of automated means to access information without authorization.
- g. Compliance with Community Standards: In the event of interaction between Users, the User undertakes to behave in a respectful manner.
- h. Responsibility for the Use of Content: The User acknowledges that the use of the content is at their own risk.
- i. Prohibition of the Introduction of Viruses: The User undertakes not to introduce viruses or malicious code.
- j. Cooperation in Improving Security: The User undertakes to report any vulnerabilities detected.
Obligations of MentorPlaces towards the User
11. MentorPlaces undertakes to:
- a. Provision of the service: Provide its services in a professional manner, using reasonable efforts and in accordance with standard industry practices, without guaranteeing the achievement of any specific results.
- b. Responsibility for content: Use reasonable efforts to provide useful, understandable and consistent information, without guaranteeing the accuracy, completeness or continuous updating of the content, in accordance with the exclusion of liability provisions.
- c. Maintenance and updates: Endeavor, within its technical and operational capabilities, to keep the information and content of the Website reasonably up to date, without assuming any obligation of continuous or immediate updating.
- d. Security and data protection: Implement reasonable and appropriate technical and organizational measures to protect information security and personal data, in compliance with applicable regulations.
- e. Transparency of information: Provide clear and understandable information regarding its services and, where applicable, information or services offered by third parties, without prejudice to the informational and guidance-only nature of the content and the limitations arising from external sources and automated processes.
- f. Non-discrimination: Provide its services without discrimination on any grounds protected by applicable law.
- g. Duty to notify: Inform Users, by reasonable means, of changes that materially affect the terms of use or contracted services, where required under applicable law.
- h. Truthful advertising: Provide advertising regarding its own services in a clear, identifiable and non-misleading manner, in accordance with applicable legislation.
- i. User support: Make a customer support service available to Users for handling inquiries, incidents or complaints, without implying an obligation to resolve all requests in the User’s favor.
Cost of the Service
12. MentorPlaces provides Users with free information, guidance and basic educational advisory services.
13. MentorPlaces may additionally offer advanced, personalized or specialized educational and career guidance and support services, which may be subject to a fee. Such services shall be offered to the User in a clear manner prior to contracting, indicating their features and price.
14. The contracting of paid services shall always be voluntary and shall be governed by the specific terms and conditions indicated at the time of contracting.
15. Services offered by third parties may be free of charge or subject to a fee and shall be governed by their own terms and conditions.
Exclusion of Liability
16. MentorPlaces makes reasonable efforts to ensure that the information, content, data, recommendations and results provided through the Website are accurate, complete and up to date. However, due to the nature of the service and the volume, diversity and origin of the data processed —including information from official sources, educational institutions, third-party partners, public sources and automated data collection, processing, combination and analysis processes— MentorPlaces cannot guarantee the accuracy, completeness, timeliness or absence of errors in all information published.
17. In particular, MentorPlaces shall not be liable for:
- a. Inaccurate or outdated information: Errors, omissions, inaccuracies or outdated information, especially where such information originates from third parties or is generated through automated processes.
- b. User decisions: Any personal, academic, professional, financial or other decisions made by the User based on the information, recommendations, classifications, suitability models or results displayed on the Website.
- c. Discrepancies with third parties: Differences between the information published on the Website and the information, conditions or requirements ultimately provided by educational institutions, universities, training companies or third-party service providers.
- d. Informational nature of the content: Use of the information for purposes other than informational or guidance purposes only, it being the User’s responsibility to verify and confirm such information directly with the relevant sources or entities.
- e. Force majeure: Damages or losses arising from force majeure events or circumstances beyond MentorPlaces’ reasonable control, including, without limitation, telecommunications failures, power outages, natural disasters, labor disputes, governmental acts, pandemics or cyberattacks.
- f. Technical failures or service interruptions: Interruptions, malfunctions, temporary unavailability of the Website or any of its services, as well as loss of information resulting from technical incidents, maintenance operations, updates or failures in MentorPlaces’ systems or those of third parties.
- g. Reliance on third-party services: Damages arising from the operation, availability or content of services, platforms, links, tools or systems provided by third parties.
18. The User acknowledges and agrees that the information provided through the Website is for informational and guidance purposes only, and that MentorPlaces does not act as an official source nor guarantee any specific results.
19. This exclusion of liability shall apply to the fullest extent permitted by applicable law and shall not affect any liability that cannot be lawfully excluded.
Intellectual Property and Copyright
20. All content of the Website, including, without limitation, texts, course listings, institution profiles, database structures, categorizations, classifications, reports, recommendation algorithms, suitability models, design, source code, interfaces, as well as the selection, arrangement, processing, enrichment and presentation of the information, is the exclusive property of MentorPlaces or of third parties who have authorized its use, and is protected by intellectual and industrial property regulations and by database protection legislation.
21. Although part of the information displayed may originate from public sources or third parties, the collection, selection, cleansing, structuring, verification, enrichment, combination and presentation of such data constitute a protected database under Spanish and European legislation, and MentorPlaces holds the exclusive rights of exploitation thereof.
Limitations of Use and Prohibitions
22. It is expressly prohibited, without the prior written authorization of MentorPlaces:
- a. The extraction, reuse, copying, reproduction, downloading, indexing, redistribution, publication, transmission, sale, sublicensing or exploitation, in whole or in part, of the content or databases of the Website.
- b. The creation of derivative databases, information services, comparison tools, search engines, artificial intelligence training models, or similar products or services based on the data or content of the Website.
- c. The use of the content for commercial, competitive, resale or indirect exploitation purposes, in whole or in part.
23. The User is only authorized to access and use the content of the Website for personal, private and non-commercial use, within the scope of the services offered by MentorPlaces.
Prohibition of Use for Artificial Intelligence Training
24. The use of the content, data, texts, listings, database structures, classifications, recommendations, results, interfaces or any other element of the Website, whether in whole or in part, for the training, fine-tuning, validation or improvement of artificial intelligence models, machine learning systems, language models, recommendation engines, search engines or other automated systems is expressly prohibited, regardless of whether such use is carried out by individuals, companies, technology platforms or third parties.
25. This prohibition also extends to the use of data mining techniques, large-scale data extraction, web scraping, automated indexing or any other technical method aimed at collecting, analyzing or reproducing the content or databases of the Website for the purposes of developing, training or exploiting artificial intelligence systems or derivative products.
26. Any unauthorized use of the content or databases of the Website for these purposes shall constitute an infringement of intellectual property rights, of “sui generis” database rights, and an act of unfair competition, entitling MentorPlaces to exercise all applicable legal actions, including actions for cessation, compensation for damages, and access blocking.
Enforcement of Rights
27. Any unauthorized use of the content, data structures or databases of the Website may give rise to the exercise by MentorPlaces of all applicable legal actions, including actions for infringement of intellectual property rights, “sui generis” database rights and acts of unfair competition, as well as claims for the corresponding damages.
Other Legal Aspects
28. MentorPlaces reserves the right to modify, suspend, update or remove, at any time and without prior notice, the structure, design, content, functionalities, services, tools, prices, access modalities or conditions of the Website, as well as to introduce new free or paid services. Such modifications may be made for technical, legal, commercial, service improvement, security, business model evolution or any other justified reasons. Where changes materially affect the rights of registered Users or contracted services, MentorPlaces shall notify Users by such means as it deems appropriate.
29. MentorPlaces reserves the right to suspend, restrict or terminate a User’s access to the Website, their account or the services, temporarily or permanently, in the following cases:
- a. The User breaches these Terms of Use.
- b. There are indications of fraudulent, abusive, automated or unauthorized use of the Website.
- c. The use of bots, scrapers, automated tools or data extraction techniques is detected.
- d. Activities are carried out that may harm MentorPlaces, other Users or third parties.
- e. False, inaccurate or misleading information is provided.
Such suspension or termination shall not entitle the User to any compensation and shall not affect any outstanding obligations or the legal actions that MentorPlaces may exercise.
30. If any provision of these Terms of Use is declared null, illegal or unenforceable, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Invalid or unenforceable provisions shall be replaced by valid provisions that most closely approximate the original economic and legal intent. The failure by MentorPlaces to exercise, at any time, any of the rights granted to it under these Terms shall not be construed as a waiver of such rights.
Applicable Law and Jurisdiction
31. These Terms of Use shall be governed in all respects by Spanish law. For the resolution of any conflict, dispute or claim that may arise from access to, use of, or contracting of services through the Website, the parties expressly submit to the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that may apply, except where mandatory consumer and user protection regulations require a different jurisdiction.
32. These Terms of Use shall enter into force as of their publication on the Website and shall apply to all Users from that date.
MentorPlaces reserves the right to modify these Terms of Use at any time for legal, technical, commercial or service development reasons. Updated versions shall be published on the Website, indicating the date of the latest revision, and shall be applicable as of their publication. Where changes materially affect the rights of registered Users or contracted services, MentorPlaces shall inform Users by reasonable means, such as email or notices within the Website.
